Sexual assault can be generally defined as an assault of a sexual nature on another person, or any sexual act committed without consent of the other person. It is a serious crime in Canada, and the mere accusation of sexual assault can severely damage a person’s reputation, often irreparably. The age of the complainant often determines which laws apply and which defences may be available.
The victim of sexual assault can be either a man or a woman, and the attacker can be of the same sex as the victim. Additionally, a spouse can also be charged with sexual assault against their partner.
